TERMS AND CONDITIONS

Use of our website and the sale and purchase of goods from the website are governed by our terms and conditions as set out below.

These terms and conditions apply to all goods purchased from Altergen, whether purchased in person, by mail order, via our website or online shop.

1. Description of Goods
Whilst we take the utmost care to ensure the product descriptions, pictures, information and prices are accurate, we do not accept liability for any inaccuracies, errors or omissions. Colours may vary from those shown on the website.

2. Payment Methods & Prices
You may purchase products from this site using a Mastercard, Visa, Delta, Switch, Maestro, Solo, or AMEX. Alternatively you may send a crossed cheque or international money order made payable to ALTERGEN Ltd.

All prices are in G.B. pounds sterling (£) and credit / debit card transactions for orders outside the UK will be converted by the card company at their current exchange rates.

Prices are subject to change without notice, hence any subsequent purchases of the same product cannot be guaranteed at the same price.

Orders are accepted at our sole discretion and we maintain the right to decline orders without giving an explanation.

3. Guarantee
All products supplied are covered by a manufacturer’s guarantee against defects in workmanship. Guarantee periods vary from product to product.  The guarantee covers replacement of faulty parts. This does not affect statutory rights. .Altergen Ltd will not be responsible for minor imperfections of products or product finishes which may or may not have occurred in transit and do not materially affect the performance of such products.

If a refund is offered, the goods must be returned to Altegen Ltd, before the refund can be issued.

In the event of a component failure due to faulty components or workmanship, the component will be replaced free of charge during the guarantee period only. Once we have established the reason for failure, Altergen Ltd may refund the shipping costs assuming that the items has failed due to faulty workmanship or materials. If the item has failed due to wear and tear, misuse or damage, no refund will be issued.  No exchange will be given without the return of the original part, although obviously this does not affect your statutory rigths. This guarantee has specific exclusions:

·         Wear and tear

·         Accidental damage or damage due to misuse 

·         Damage caused to wind turbines and electronics by exposure to high winds, or gusts exceeding the maximum design speed of the turbine. The turbines we supply are designed for high output at low wind speed, and are therefore unsuitable for high wind areas. Use of these wind turbines in coastal areas or use in other high-wind areas is at the customer's risk only.

·         Damage caused to electrical components by disconnecting any component during operation. Disconnection of the inverter, batteries, charge controller or turbine whilst any component is powered/delivering power can cause irreversible damage. This type of misuse is not covered by the guarantee.

·         The guarantee is automatically invalidated if any part of a system is modified (even if the modified part is not the component that has failed), unless prior agreement is obtained in writing from Altergen Ltd

·         Damage caused to the wind turbine or blades caused by over-spinning due to running without suitable load or battery connected

·         Damage caused to wind turbine by out-of-balance hub/blades. The responsibility of balancing the blades lies with the installer, who must do so AFTER assembly

·         Damage caused to wind turbine blades due to abrasion by particles carried by the wind.

No liability is accepted for any damage caused to persons or property as a result of failure to follow product safety instructions, misuse, or as a result of alternative installation methods, fixings or applications outside of those set out by Altergen Ltd. All machinery and equipment supplied by Altergen Ltd, and wind turbines in particular should be operated a safe distance from individuals and property. If you are unsure of the acceptable safe distance, please consult before setting up the equipment. The turbine should not be erected where tower failure or turbine failure can cause the machinery to fall onto cars, individuals or propety. When the wind turbine is operational, no personnel should come within a distance equivalent to twice the tower height for safety reasons. Any injury caused by failing to heed these warnings will not be the liability of Altergen Ltd.

Altergen Ltd denies any liability for damage to any other equipment that may be used in conjunction with our products unless it can be demonstrated that our equipment is at fault. This is because we have no control over what equipment is used or how it may be used, and therefore we are not in a position to guarantee its safeguard. Sometimes incompatibility can occur between different types of equipment, or some equipment may be designed for light duty use only - although this may not be immediately apparent. If in doubt please consult us beforehand.

4. Your Right To Cancel
You have the right to cancel your order within seven working days of delivery and return the goods supplied to us for for a refund of the price of the goods. You must notify us in writing during this period of your intention to cancel by

Any goods supplied must be returned to address above at your own expense within the seven days of your notice to cancel.

Unless the goods are defective, damaged or not as specified on your order acknowledgement, you are responsible for the cost of returning the goods. We recommend that you use Recorded Delivery, as proof of shipping is not proof of receipt. If, however, the goods are faulty then the postage costs will be refunded.

DSR: The introduction of the Distance Selling Regulations (DSR) gives the consumer the right to a 'cooling off' period of seven (7) days once they have received goods via mailorder.  

The 'cooling off' period is essentially a right to cancel your order for any reason and return them to us without charge.

The DSR does not cover faulty goods, used goods or goods with packaging that has been damaged or lost - this will be dealt with under our normal returns procedure. The packaging for many of our products is custom-made to provide maximum protection for the product during transportation, at significant cost, and is therefore its return is required in the event of rejection of the goods.
If you have received goods from us and have changed your mind, you may return them to us subject to the following conditions:
1.  You must inform us within seven working days in writing (fax, letter or in person) that you are rejecting the goods.
2.  The item(s) must be in new condition, complete with all original packaging, without damage.
3.  The DSR do not apply to any software or goods that have been custom-made or ordered in specially to the customer's requirements for example: a specially-made cylinder or a non-stock item.

Altergen Ltd will refuse any items returned if:
1.  The goods have not been returned within 14 days. This does not affect your statutory rights
2.  The product is not adequately packaged.
In some cases, our packaging is purposely designed at considerable cost, to ensure safety in transit. Please retain this packaging should there be a need to return the item for any reason, until you are satisfied with the goods. If you do lose the packaging and it becomes necessary to return the goods, please contact us to arrange replacement packaging.
3.  We have not been notified in writing within 7days of purchase, of your intention to reject the goods
Goods that are rejected outside of the conditions imposed above will be returned to the customer at the customer's expense. The goods will not be returned until the customer has paid these costs. The customer must contact Altergen Ltd to arrange payment of the return cost of the goods within a reasonable time, failing which Altergen Ltd will take measures to dispose of the goods, in accordance with Section 12 and Parts I and II of Schedule 1 of the Torts (Interference with Goods) Act 1977.
This does not affect your statutory rights.

5.Financial
1. Title to all goods and equipment remains with Altergen Ltd until paid in full. Altergen Ltd reserves the right to collect, dismantle and/or remove equipment and to arrange its return in the event of non-payment. Altergen Ltd will not be responsible for any losses incurred by the customer by Altergen Ltd exercising this right. In the event of non-payment or returned payment, any costs incurred by Altergen Ltd in recovering its property will be the responsibility of the customer. Altergen Ltd reserves the right to take all necessary steps to recover equipment that has not been paid for. The customer grants Altergen Ltd access to repossess any equipment not paid for in full.

2. Goods may be returned within 14 days for a refund, if they are returned unused and in original packaging. This does not affect your statutory rights.

3. No refund will be given for goods that have been modified or damaged. Because of the nature of the goods, it is essential that they are returned in the original packaging in order to provide adequate protection in shipping. If the original packaging is not available the customer should contact Altergen to discuss adequate return packaging before the sending the goods. No refund will be given for items that have been dismantled, tampered with or have parts missing, unless by prior agreement in writing.

4. Altergen Ltd does not operate any credit facilities or monthly accounts. All payments are due on or before the date of despatch. Any overdue amount will be charged at an interest rate of 2% per month. Interest charges will be round UP to the nearest month.

5. The customer will be responsible for any costs incurred to Altergen Ltd in failed payments from customers - for example cheques returned either unpaid or stopped. Any costs incurred by Altergen Ltd in recovering these debts will be the responsibility of the customer. Altergen Ltd reserves the right to withhold delivery of any goods purchased by the customer until such costs have been paid.

6. Altergen Ltd does not operate any 'sale or return' policy for distributors or installers. This can only be arranged by prior agreement in writing. (This is not applicable to retail customers).

6. Delivery Arrangements
All goods are sold subject to availability. Your shopping basket displays the goods you have purchased. Allow 28 days for delivery.  Where goods are out of stock and need to be ordered we will contact you and advise you accordingly. Some Altergen Turbines are imported to order therefore allow 56 days for delivery.

The delivery costs are shown depending on the shipping destination and the delivery service selected. Any delivery times quoted are estimates, based on availability and normal delivery time, in working days. Additional time should be allowed where payment is made by cheque, as we will not despatch goods until the cheque has cleared.

Altergen Ltd do not accept responsibility for the security of the goods during transit.

a) Standard insurance only is provided, unless the customer has requested otherwise in writing. Standard insurance is £2.50/kg. Any claim against Altergen Ltd for loss or damage in transit is limited to this level unless additional cover has been requested in writing, agreed and paid for.

b) It is the customer's responsibility to ensure that goods are thoroughly checked for damage before signing 'received in good condition'. Failure to do so will invalidate any shipping insurance claim. Altergen Ltd will not be held responsible for any insurance claim for damage where a signature has been received by the courier on delivery indicating that the goods were received in good condition

c) Altergen Ltd requires that in the event of shipping damage, the customer must retain all packaging and equipment for inspection by the company and/or the courier. Failure to do so will invalidate the shipping insurance. Damaged goods must be returned to Altergen Ltd at the customer's expense if they are to be replaced. No replacement or refund will be granted prior to the outcome of the courier's investigation, and will be dependant on a successful outcome.

7 Special Terms for Export:
For the purpose of these terms and conditions, 'export' means purchases made by companies or individuals outside England, Wales and Scotland.  These specific 'export' terms and conditions will also apply to sales made to companies in the UK, if the goods are shipped outside of England, Wales or Scotland, be it carried out by the customer or by Altergen Ltd on behalf of the customer.

In addition to the standard terms and conditions above, the following conditions will apply:

1. Damage to the goods in transit is more likely with long-distance shipments. Therefore it is advised that the customer should make appropriate arrangements for insurance of the cargo. If the customer wishes Altergen Ltd to arrange the insurance, this must be provided in writing to Altergen Ltd at the time of sale, specifying the value of cover required. The value of the cover may not exceed the value of the goods.

2. If insurance has been taken out on behalf of the customer by Altergen Ltd, no payment shall be made to the customer in respect of damage or loss of the goods until the shipping company has paid compensation to Altergen Ltd in respect of damage or loss of the goods. The amount payable by Altergen Ltd to the customer shall not exceed the amount paid to Altergen Ltd by the insurance company.

3. In the event that goods are damaged in shipping, or in the event that the goods fail due to faulty goods or workmanship, in accordance with the standard terms and conditions and the specific export terms and conditions outlined above, the cost of shipping faulty or damaged parts back to Altergen Ltd, including any duty, customs clearance costs, agents fees or other export-related cost and the cost of shipping the replacement part out to the customer including any duty, customs clearance costs, agents fees or other export-related cost is the responsibility of the customer. Alternatively, the customer may visit our premises by arrangement to exchange the faulty unit. No exchange or refund will be given without the return of the original part.

8. Trademarks and Copyright
All third party copyright, trademarks, brand names, product names and titles on this website are acknowledged. This website is protected by Copyright and the Copyright, Trademarks, Logos and Intellectual Property rights for the content of this website are the property of Altergen Ltd. ALL RIGHTS RESERVED. Any use, printing or copying of materials on this website, other than in the course of browsing, selecting products and ordering from us, is strictly prohibited. Any copying of this website is prohibited.

9. Security
Security is one of our highest priorities and we take every precaution to protect your personal information both online and offline. Information requested when registering or ordering goods (including your credit / debit card details) is encrypted with SSL (Secure Socket Layer), the industry standard encryption software.

10. Information Collection and Use
We are committed to protecting your privacy. We use the information we collect about you to process orders and to provide a more personalised shopping experience. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998. We will not sell, share, or rent this information to other vendors other than as disclosed in this statement. During the registration or ordering process we collect some or all of the following information:

• Your name and address
• Your contact telephone numbers (to enable us to contact you in the event of a query)
• Your e-mail address
• For credit / debit card purchases your card details

11.Definitions:
'in writing' : postal letter, fax or hand-written notice. This does not include emails or verbal conversations.   
misuse': any form of use which is not specified by Altergen Ltd or the product manufacturer.

12. Links to / from 3rd Party Websites
We are not responsible for and accept no liability for the content or privacy practices of any linked website which is not owned and maintained by us. We encourage our users to be aware when they leave our website and to read the privacy statements of each and every website that collects personally identifiable information.

13. Legal
The contract will be governed by the laws of
England and Wales and you agree to submit to the jurisdiction of the English courts.
These terms and conditions do not affect your statutory rights as a consumer.
